1. Acceptance of Terms

By downloading, installing, or using the Crest app ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

Crest is operated by Fem Valetudo Pty Ltd (ACN 693 141 623), referred to as "we", "us", or "our".

2. Description of Service

Crest is a menopause symptom tracking application that allows you to:

• Track physical and mental health symptoms
• Monitor medication schedules and adherence
• Record period and cycle information
• View patterns and insights based on your tracked data
• Generate reports to share with healthcare providers

3. Medical Disclaimer

Do not disregard professional medical advice or delay seeking treatment because of information or insights provided by the App. If you are experiencing a medical emergency, contact emergency services immediately.

4. Eligibility

You must be at least 18 years old to use Crest. By using the App, you represent and warrant that you are 18 years of age or older.

5. Subscription Terms

Subscription details:

• Pricing: $4.99 AUD per month or $39.95 AUD per year
• Free Trial: New subscribers may be eligible for a 7-day free trial
• Payment: Payment will be charged to your Apple ID account at confirmation of purchase
• Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Management: You can manage and cancel subscriptions in your Apple ID Account Settings

Free trial terms:

• If offered, the free trial period lasts 7 days
• Any unused portion of the free trial is forfeited when you purchase a subscription
• You will be charged at the end of the free trial unless you cancel at least 24 hours before it ends

6. User Responsibilities

You agree to:

• Provide accurate information when using the App
• Keep your device secure and not share access with others
• Use the App only for its intended purpose of personal health tracking
• Not attempt to reverse engineer, modify, or create derivative works from the App
• Not use the App for any unlawful purpose

7. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Fem Valetudo Pty Ltd and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Your Data

Your health data is stored locally on your device. Please refer to our Privacy Policy for detailed information about how we handle your data.

You are responsible for maintaining backups of your data. We are not liable for any loss of data stored on your device.

9. Research Participation

Crest offers optional participation in research conducted with Macquarie University. Research participation is:

• Completely voluntary
• Subject to separate informed consent
• Governed by ethics approval from Macquarie University Human Research Ethics Committee

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information obtained through the App

11. Limitation of Liability

To the maximum extent permitted by Australian law, Fem Valetudo Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data
• Loss of profits or revenue
• Personal injury or health outcomes
• Any damages arising from your use of or inability to use the App

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Fem Valetudo Pty Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Modifications to the App and Terms

We reserve the right to:

• Modify, suspend, or discontinue the App or any features at any time
• Update these Terms from time to time

Changes to these Terms will be posted in the App and on our website. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

14. Termination

You may stop using the App at any time by uninstalling it from your device. We may terminate or suspend your access to the App if you violate these Terms.

Upon termination, your right to use the App ceases immediately. Data stored locally on your device will remain until you delete the App.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of New South Wales.

16. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
